<li><strong>Fuente del requerimiento: cumplimiento operativo y prevención de riesgos (política de aerolínea):</strong><br />Aerolíneas como American Airlines advierten expresamente que, si un menor viaja internacionalmente sin ambos padres, <strong>puede requerirse</strong> una “Letter of Consent”, lo que respalda que el requisito opera como <strong>control privado de cumplimiento</strong> en el check-in/puerta.²<br />Asimismo, guías gubernamentales de información al público reconocen que, si un menor viaja con solo uno de los padres, <strong>puede necesitar</strong> una carta de consentimiento del otro custodio, por razones de seguridad y prevención de sustracción internacional.³</li>
<li><strong>Validez formal en California: comparecencia física y rechazo de “webcam notarizations”:</strong><br />La Secretaría de Estado de California ha señalado que las notarizaciones por webcam/online <strong>son inválidas e ilegales</strong> para notarios californianos, por cuanto el sistema exige <strong>comparecencia personal</strong> conforme a las reglas vigentes.⁴<br />El <strong>California Notary Public Handbook (2025)</strong> reafirma el marco actual y ubica la notarización remota como un esquema a implementarse progresivamente bajo condiciones futuras, no como práctica general vigente para notarios CA hoy.⁵</li>
<li><strong>Texas como vía habilitante: Remote Online Notarization (RON) y límites de ejecución:</strong><br />Texas reconoce al <strong>online notary public</strong>, autorizándolo a realizar notarizaciones remotas mediante conferencia audio-visual.⁶<br />No obstante, la normativa administrativa exige que el <strong>notario online esté físicamente en Texas</strong> al momento de la notarización.⁷ Esto es crucial para estructurar un cierre formal correcto cuando el firmante está fuera del estado.</li>
<li><strong>Firma por representante (POA) en Texas: fórmula notarial y riesgo de aceptación práctica:</strong><br />La Secretaría de Estado de Texas publica lenguaje certificado para notarización online en supuestos donde firma un <strong>representante</strong> (p. ej., “representative/attorney-in-fact”), lo que permite estructurar un consentimiento firmado por apoderado <strong>siempre que</strong> el poder lo autorice expresamente y se adjunte como sustento.⁸<br />Aun así, se recomienda validar previamente con la aerolínea, porque algunos agentes prefieren firma directa del progenitor no viajante (criterio de operación, no de nulidad intrínseca del acto).</li>
<li><strong>Apostilla como estándar internacional (uso en Perú):</strong><br />Para documentos que surtirán efectos en el extranjero, la apostilla bajo el Convenio de La Haya es el mecanismo estándar. El Departamento de Estado de EE. UU. distingue apostilla vs. autenticación según el país de destino y su pertenencia al Convenio.⁹<br />Perú es Estado parte (depósito del instrumento de adhesión en 2010), lo que respalda el uso de apostillas para documentos públicos extranjeros.¹⁰<br />En Texas, el trámite oficial de “Universal Apostille” exige identificar el país de uso y pagar la tasa por documento, conforme a la guía estatal.¹¹<br />En California, la Secretaría de Estado también regula el procedimiento de apostilla para documentos que se usarán fuera de EE. UU.¹²</li>
